THOSE IN RECEIPT OF THIS NOTICE, most importantly the UNITED STATES GOVERNMENT, THE UNITED STATES MILITARY and THE STATE OF HAWAII and its Constituent
Agencies...
ALOHA.
AS KANAKA MAOLI, We are the Spirit of the Spirit of our Ancestors before Us. Our sovereignty is a gift from God and We were placed here as caretakers of these ‘Isles of the Sea’. Hawai`i has been and continues to be our home; it is our Jurisdiction and it is our Responsibility to care for it.
WE, THE UNDERSIGNED, on
behalf of the KINGDOM OF HAWAI`I,
place all those responsible on NOTICE and DEMAND to CEASE and DESIST all current and proposed Activity, of any nature,
in the Air, Land and Waters of the Hawaiian Kingdom. On this note, we submit
the following:
NOTICE
AND DEMAND
WHEREAS, Under
the laws of the KINGDOM OF HAWAI’I,
along with the Treaty of Friendship, Commerce and Navigation, which still
legally exists between the United States and the Kingdom of Hawai`i, we submit
this NOTICE AND DEMAND to the UNITED STATES GOVERNMENT, the UNITED STATES MILITARY, and the De facto STATE OF HAWAI`I and its Constituent Agencies.
WHEREAS, the UNITED STATES GOVERNMENT, the STATE OF HAWAII and its Constituent
Agencies claim ownership of the Land, Air, and Waters of the Hawaiian Kingdom where current and
proposed Activity is located.
WHEREBY,
The Land Laws of the Kingdom of Hawai`i clearly state that if the Kingdom
should fall into Alien Hands and no longer be under Kingdom Rule, all land
titles issued in Ano (less than) Allodial would automatically revert to the
Kingdom.
WHEREBY, the UNITED STATES
GOVERNMENT, the STATE OF HAWAII and
its Constituent Agencies, and All Landowners after 1848, acquired land in
Ano (less than) Allodial. This means the ownership of that land remained with
the Kingdom and possession was for agreed usage of the lands only.
WHEREBY, The Allodial Patents of all Lands
in Hawai`i mean they are Inalienable and Unalienable...not to be Sold or Purchased
outright, or Taken, even by war. Treaties protected this status.
WHEREBY, the UNITED STATES GOVERNMENT, the STATE
OF HAWAII and its Constituent Agencies, and all other so called ‘Land Owners’
in Hawai’i, do not have clear title to the land. Land titles are held by the
Kingdom of Hawai’i and have been placed into Trust for all Kanaka Maoli and
those yet unborn.
WHEREBY, It would be in the best
interest of the UNITED STATES GOVERNMENT,
its MILITARY and the STATE OF HAWAII and its Constituent
Agencies, to Cease and Desist all operations on Kingdom Land, Waters and
Airspace...and Vacate Hawaii.
WHEREAS, THE STATE OF HAWAI`I AND ITS
CONSTITUENT AGENCIES, who claim to be the Sovereign Body Politic
with Jurisdiction and Authority over the Hawaiian Islands, exist without a
valid Constitution and are an ‘illusion’ created by the United States
Government.
WHEREBY,
The
Overthrow of the Hawaiian Kingdom by citizens of the United States, with the
support of the U.S. Military, was clearly a violation of International
Law.
WHEREBY, In a letter to Congress, then
U.S. President Grover Cleveland referred to the Overthrow of the Hawaiian
Kingdom as, “...of itself, an Act of War”.
WHEREBY, It
is against the Constitution of the United States to annex territory, outside
its contiguous forty-eight States, without a Treaty of Annexation.
WHEREBY, ‘Statehood’ was alleged by a
U.S. Joint Resolution of Congress which has no legal authority outside the
contiguous forty-eight States OR, in International Law.
WHEREBY,
Public Law 103-150, a confession and admission of guilt for the overthrow of
the Hawaiian Kingdom, was passed by Congress and signed into law by U.S.
President Clinton in 1993.
WHEREBY, The
de facto State of Hawai`i cannot, and does not, own ANY lands in Hawai’i.
Without a land base, it cannot be a sovereign entity. Therefore, it has no Jurisdiction
or Authority over any of the Islands in the Hawaiian Archipelago; it is not the
Sovereign Body Politic of the Hawaiian Islands.
WHEREBY,
as
Kanaka Maoli, we have lost trust in the United States and remind them of the
following:
1. It
was the United States Government that stole our Independence and our lands.
2.
It
was the U.S. Marines (aka Navy) who assisted in the overthrow of the Hawaiian Monarchy in 1893.
3. It
was the presence of the U.S. Navy at Pearl Harbor that made Hawai`i a target in World War II.
4.
It
was/is the United States that brought greed and speculation to Hawai`i, thereby
destroying our environment and desecrating our sacred sites.
5.
It
was/is the United States Government that committed genocide on our population
and nearly eliminated our culture and our language.
6.
It
is the United States government that continues to impose violations upon our
Health, the Health of our Air, our Land, our Waters and their respective Life
Forms.
7. The
most appropriate action the U.S. Government, its Military and Constituent
Agencies can do for the Kanaka Maoli, and all Kingdom Citizens, is to vacate
the Kingdom of Hawai`i.
THEREFORE, THIS NOTICE AND DEMAND serves as a WARNING to the UNITED STATES GOVERNMENT and the De facto STATE OF HAWAII and its constituent agencies. We, Kanaka Maoli will no longer stand by as you further contaminate Our Lands, Air and Water. As Native Tenants of the Kingdom of Hawai`i, we will no longer tolerate the Genocide of Our People, Theft of Our Lands and Resources, Diversion of Our Water, Poisoning of Our Environment, Fraud, Extortion, Manipulation, etc. against Ourselves, Kingdom Citizens and Future Generations. Violations will be dealt with.
